There are two primary laws that make it mandatory for employers to pay overtime to employees: the federal Fair Labor Standards Act (FLSA) and California’s labor laws.

The FLSA requires employers to pay workers time-and-a-half normal wages for any hours they work over 40 per week. FLSA applies to nearly all employers and there are few exemptions to this law.

Under California labor law, employees are entitled to mandatory overtime pay at the rate of one and a half times their normal rate of pay for any hours worked more than eight hours per day or 40 per week. Additionally, employees are to receive twice their rate of pay if they work more than 12 hours per day or eight hours per day for seven or more consecutive days. A worker must be classified as non-exempt in order to qualify for overtime pay.

Increased pay is not required for work on the weekends, holidays, or other days considered “days of rest” unless overtime is worked on those days.
